1. Introduction

Government directed Ministry of Agriculture and Forestry (MAF) to commission a review of the history and basis of the allowance for irrigation opportunities in the Waitaki catchment as provided for by the 3rd Schedule of the 1969 Order in Council.

MAF commissioned Opus to undertake an investigation into the circumstances pertaining to the 1969 Order in Council relating to the Upper Waitaki Catchment. The 1969 Order in Council granted the Minister of Electricity the right to dam, use, discharge, divert and take water in defined locations of the Upper Waitaki for generating electricity. This right was transferred to the Electricity Corporation of NZ through a 1988 Sale and Purchase Agreement between the Corporation and Crown.

This investigation report is based on material sourced from a variety of locations and with the assistance of many people and organisations (see section 9). Telephone contact with people knowledgeable about the events and location of the associated records assisted in the location of the material. The assistance provided is appreciated.

The short time period for the investigation and the historical nature of the information means that there are gaps in the information. These have been identified in the investigation report where necessary.

A copy of the material used in compiling this report can be supplied separately for reference.
