17 Publishing Requirements
International Standard Book Number
If your final product is being published, it will probably need an International Standard Book Number (ISBN). It will need an ISBN if it is:
- a book or pamphlet with more than four pages of text;
- an electronic publication e.g. CD-ROMs and internet publications;
- a talking book (books on cassette or CD);
- a multi-media kit containing printed material.
If your publication falls into any of the above categories, it requires an ISBN by law. Your field day/workshop notes or printouts from a presentation do not require this.
An ISBN is a unique identification code that allows publishers, book suppliers and libraries world wide to easily locate and order the item.
To get an ISBN for your publication call the Fund Administrator in Wellington on 04 894 0612 or 0800 100 087, alternatively email your request to sffund@maf.govt.nz
To issue you an ISBN we will need to know:
- the project title and project number;
- the title of the publication;
- the approximate date of publication;
- the contact person for queries;
- the cost of the publication to purchase or is it free of charge;
- is the publication going to be available on the web?
Where to put your ISBN
For books/pamphlets:
- on the reverse of the title page; or
- on the lower section of the outside back cover; or
- on the foot of the title page if there is no space elsewhere.
For electronic material:
- on the label of the container if the publication is issued in one, e.g. a diskette or CD-ROM; or
- on the title display/first display (CD-ROM, internet publications); or
- on the credit titles (film, video).
The ISBN must be printed as given, for example ISBN 0-473-03101-9.
Copyright
Copyright is a protection that covers published and unpublished scientific, literary, and artistic works which are fixed in a tangible or material form.
For a work to qualify for copyright protection, it must also:
- be sufficiently original; and
- the author must be a person as defined in the Copyright Act 1994;
- copyright laws grant the creator the exclusive right to reproduce, prepare derivative works, distribute, perform and display the work publicly. It also gives the owner of the copyright a right of action against unauthorized copying of original work.
Under the Act, copyright protection comes into existence automatically upon the creation of any original work.
Registration of copyright is not required and no formal system for the registration of copyright exists in New Zealand.
Although not required by law, it is a good idea to include a copyright statement or notice on a work. This will inform others that the work is subject to copyright protection and that consent is not granted for others to copy the work or deal with it in any other way restricted by copyright.
A common form of copyright notice consists of the © symbol, the name of the copyright owner and the year the copyright work was first published. For example: © Ministry of Agriculture and Forestry, 2006.

Copyright Protection Overseas
The Act gives effect to the various international agreements to which New Zealand is a signatory.
Participation in these Agreements means that when an original work is created in New Zealand, it is not only protected by copyright in New Zealand, but also automatically protected under the copyright laws in other countries that are members of the World Trade Organisation. As in New Zealand, it is not necessary to register for copyright protection in these countries – copyright protection arises automatically upon the creation of any original work. This means that when original works are created in other countries, they are also protected in New Zealand.
A general copyright statement you may like to use on your work could be something like this:

All rights reserved. No part of this publication may be reproduced or transmitted in any form or by any means, electronic, mechanical, photocopy or otherwise or stored on any retrieval system of any nature without prior written permission of the copyright holder.
For many projects an alternative statement that encourages wider circulation and use of your results while also providing protection and recognition of the authors could be something like this:

All rights reserved – material contained in this report may be reproduced or published without further licence provided that it is not reproduced for profit and acknowledgement is made of this source.
Disclaimer
If a disclaimer is required, you must ensure that it is relevant and linked to the purposes of the document, so that readers can clearly understand what the disclaimer is for and why it is there.
The disclaimer should be at the front of the publication along with the copyright and publisher information. It should be clearly headed "DISCLAIMER".
Standard disclaimers can be used but it is very important that what you are disclaiming against is relevant to the purpose of the document.
Below are three sample disclaimers that could be adapted to your specific document:
“All information contained within [state the document title] has been checked for accuracy and published in good faith. However, the authors, [state who you are e.g. Farmer Joe Association], MAF, and any of their staff or members accept no responsibility on any grounds whatever, including liability in negligence, for the use or mis-use of the information contained in this document.”
“The information contained in this publication has been provided for the purpose of [state the purpose of the document]. It is for information only.”
“Every effort has been made to ensure the information in this publication is accurate and correct. [state who you are e.g. Farmer Joe Association], the Crown, its employees and agents do not accept any responsibility or liability, whatsoever, for any error, omission, interpretation or opinion which may be present, however it occurred, nor for the consequences of any decision based on the information supplied in this publication. The Crown, its employees and agents expressly disclaim all liability to any person relying on the whole or any part of this publication.”
